Hello Oxbow Lake! It’s a snowy one today!
The Oxbow Lake No-Development Committee has met regularly over the past year navigating the difficult waters with regard to the Application for Plan of Subdivision on Oxbow’s peninsula. Most recently we have been involved with the application being heard and then supported at the District of Muskoka and have reviewed the District of Muskoka’s Notice of Decision 2022 11 18, regarding the proposed ‘subdivision’ on Oxbow’s peninsula. From that Report: A decision was made by Muskoka District Council to grant draft approval to Plan of Subdivision File S2021-03 (Muskoka Lakeside Properties Inc.), on lands legally described as Part of Lot 3, Concession 6, former Township of Finlayson, Township of Lake of Bays, in the District of Muskoka. The Draft Plan of Subdivision and Schedule A, which includes the conditions of draft approval and the lapsing provision… (19 conditions must be met for final approval – see attached for details). Due to this decision by the District of Muskoka, we had planned to appeal to the Ontario Land Tribunal. Unfortunately, changes to the Planning Act of Ontario made a few years ago as part of an Omnibus Bill have just come to light (both to Municipal Governments and planners) that disallow appeals by third parties and corporations (i.e. OLCA). Both the decision by the District of Muskoka to support the Application for Subdivision, and the inability of OLCA to appeal to the Ontario Land Tribunal were very disappointing to the Committee. Countless hours of research, meetings, consultation with our planner, township staff, and politicians have gone into trying to understand regulations, guidelines, Official Plans, science, data, and the planning process. We appreciate everyone's donations to support this and understand the frustration around this. At this point the No-Development Committee is proposing that OLCA continue to monitor the development and building process which will focus on additional testing, engineering and construction, so that all 19 mandated conditions of the subdivision approval are met. Moving forward, we are asking for help from anyone on our lake who has skills that can assist us to ensure these conditions are met: planning, legal, engineering or scientific backgrounds.
